Our Commitment to Privacy
The KW Military Support Foundation respects the privacy of each individual who contacts us. We are grateful for your support and the crucial roles you play in helping us carry out our valuable work. As part of our commitment to safeguarding your privacy we have adopted the online privacy policy outlined below, which is applicable to all KW Military Support Foundation websites (“Sites”).
 

Collection and Use of Information and Personal Data Privacy Statement

Collection of Information
We collect two kinds of information, general usage data, which is not individually identifiable, and individually identifiable information.

General Usage Data

Our Web server automatically recognizes and collects the domain name of each visitor to the Sites. We collect information about visitors to the Sites, such as the number of visitors, what pages they access, and the length of their visit. We also may collect certain non-personally identifiable information when you visit the Sites or fill out forms such as the type of browser you are using (e.g., Internet Explorer, Chrome), the type of operating system you are using, (e.g., Windows, Mac OS) and the domain name of your Internet service provider (e.g., AT&T, Comcast, Verizon, Sprint). This information is used in aggregate form in order to manage our web sites and improve their content.

Individually Identifiable Information

We collect individually identifiable information about you when you make a donation on our website using your credit card or Paypal This information may include, but is not limited to:

• Your name
• Email address
• Name on your credit card
• Credit card number
• Credit card expiration date
• Credit card security code

Names or other identifying information about the people we support will not appear on the website.

Use of Information
Individually identifiable information collected from you when you donate, sign up for one of our newsletters, surf the website, respond to a poll or marketing communication, or use certain other site features may be used in the following ways:

• To personalize your experience and allow us to provide you with information, type of content or deliver the services you have requested as well as additional information

• To allow us to better service you in responding to your customer service requests

• To send periodic emails regarding events, activities and services using the email address which you have provided.

• Internal record keeping and to administer this website.

• We may use the information to improve our programs and services.

• From time to time, we may also use your information to contact you for market research purposes. We may contact you by email

• Send to you acknowledgements of your donations

• Send you information regarding the Foundation’s upcoming events and status of our efforts to support our troops.

If you signed up for one or more of our newsletters, you may receive periodic contacts from us.
Throughout most of the Sites, only persons who provide us with some basic requested personally identifiable information will be able to receive our newsletters.

Fair Information Practices
The Fair Information Practices Principles form the backbone of privacy law in the United States and the concepts they include have played a significant role in the development of data protection laws around the globe.

We operate in line with the Fair Information Practices and will therefore take the following responsive action, should a data breach occur:

• We will notify the donors via email within 7 business days.

• We will notify the donors via in site notification within 7 business days.

We also agree to the individual redress principle, which requires that individuals have a right to pursue legally enforceable rights against data collectors and processors who fail to adhere to the law. This principle requires not only that individuals have enforceable rights against data users, but also that individuals have recourse to courts or a government agency to investigate and/or prosecute non-compliance by data processors.

California Online Privacy Protection Act
We operate in line with the CalOPPA, which is the first state law in the nation to require commercial websites and online services to post a privacy policy. 
According to CalOPPA we agree to the following:

• This privacy policy and terms and conditions are available at all times and can be easily found in the KW Military Support Foundation Sites.

Privacy Policy Changes

If we decide to change our privacy policy, we will post those changes here and the last date on which the privacy policy was updated will be listed below. You are able to change your personal information by emailing us at donkey@badassboxes.org. We encourage you to review our policy from time to time.
 

Security and Protection of User Information

In order to prevent unauthorized access and protect our users’ personal information, we strive to maintain physical, electronic and administrative safeguards to secure the information we collect online. Our website is scanned on a regular basis for security holes and known vulnerabilities in order to make your visit to our site as safe as possible.

Your personal information is contained behind secured networks and is only accessible by a limited number of persons who have special access rights to such systems, and are required to keep the information confidential. In addition, all sensitive information you supply is encrypted via Secure Socket Layer (SSL) technology. This secure server software encrypts all information you input before it is sent to us.

All donations, are processed through a gateway provider and are not stored or processed on our servers.

We implement a variety of security measures when you enter, submit, or access your personal information to maintain its safety. For areas of our Sites that require a login, you must help us protect against unauthorized access by keeping your password in a safe place and signing off when using a shared computer. We ask that you do what is reasonable to ensure the security of your personal information.  It is recommended that you change your password frequently.

Should you engage in harmful or dangerous activities that violate the mission statement or reputation of the KW Military Support Foundation , our users or any other person, your access may be terminated, without notice. Your account may also be terminated for extended periods of inactivity.

Notwithstanding our efforts to protect your information, no security system is completely impenetrable, so we cannot guarantee the absolute security of our databases, nor can we guarantee that information you supply to us will not be intercepted while in transit to us over the Internet.
 

Social Network / Online Community Tools

Some portions of the Sites, may provide special services and offer interactive tools and features that allow users to upload information for public consumption. In some cases, users can create their groups, write comments, post blog entries, share experiences, participate in discussions and connect with others. Please remember that forums, group discussions, message boards and personal pages are public forums and personal information disclosed there will be seen by others. In addition, please exercise caution when posting information or providing information about yourself to others, especially contact information, such as street address, telephone number or email address. This privacy policy does not apply to any information posted by you in a public area of the Sites.

This does not include website hosting partners and other parties who assist us in operating our website, conducting our activities, or servicing you, so long as those parties agree to keep this information confidential.

Occasionally, we may participate in activities (e.g., events and programs) that are co-branded by or sponsored with identified third parties. By virtue of these relationships, the third parties may obtain personally identifiable information that visitors voluntarily submit to participate in the Sites activity. These third party sites have separate and independent privacy policies. The KW Military Support Foundation has no control over the third-party’s use of this information. We therefore have no responsibility or liability for the content and activities of these linked sites.

We may share your personally identifiable information with affiliates and third parties, including e-commerce partners, who assist us by providing services on our behalf, including, but not limited to, credit card processing, database management, e-mail distribution, and Web Sites management. Such parties may only use your personally identifiable information for the specific purpose for which they are provided the information.

Where KW MILITARY SUPPORT FOUNDATION discloses your personal information to its agents or sub-contractors for these purposes, the agent or sub-contractor in question will be obligated to use that personal information in accordance with the terms of this privacy statement.

In addition to the disclosures reasonably necessary for the purposes identified elsewhere above, the KW MILITARY SUPPORT FOUNDATION will disclose your personal information to the extent that it is required to do so by law, in connection with any legal proceedings or prospective legal proceedings, and in order to establish, exercise or defend its legal rights.

Finally, we may disclose your personally identifiable information to third parties in order to comply with law, law enforcement agencies, to protect our rights in or the safety of the Sites, or to protect the safety or rights of other users of the Sites.
 

Email Communications

We collect your email address in order to provide you with an acknowledgement of your donation, send information, respond to inquiries, and/or other requests or questions. We occasionally send out email newsletters and direct email communications to KW Military Support donors to highlight news and information about KW Military Support Foundation . You can elect not to receive communications from us, by noting your preference in response to communications from us. You may also select to receive only certain publications from the KW Military Support Foundation by selecting your newsletter preferences on our website. In addition, all KW Military Support Foundation e-newsletters and direct email communications have easy-to-follow unsubscribe instructions at the bottom of each e-mail piece for rapid removal of that specific mailing list. In case you have signed up to one or more of our e-newsletters and wish to stop receiving all communications from us, please make sure to unsubscribe from each of the e-newsletters to which you have subscribed.
 

COPPA (Children Online Privacy Protection Act)

When it comes to the collection of personal information from children under 13, the Children’s Online Privacy Protection Act (COPPA) puts parents in control. The Federal Trade Commission, the nation’s consumer protection agency, enforces the COPPA Rule, which spells out what operators of websites and online services must do to protect children’s privacy and safety online.
Please note that we do not specifically market to children under 13.

Some opinions and recommendations contained in the Web Sites, including personal pages, blogs, message boards, group discussions, comments and forums (“Interactive Areas”), are not necessarily those of the KW Military Support Foundation or endorsed by the KW Military Support Foundation Opinions written by guest blog or article writers who are paid by the KW Military Support Foundation for their writing, reflect the writers’ opinions, do not reflect the opinions of the KW Military Support Foundation nor are endorsed by the KW Military Support Foundation YOU ACKNOWLEDGE THAT ANY RELIANCE ON CONTENT POSTED IN AN INTERACTIVE AREA IS AT YOUR OWN RISK.

If you use an Interactive Area, you are solely responsible for your own communications and the consequences of posting those communications.

The KW Military Support Foundation does not assume any responsibility for the consequences of any Interactive Area communications on or arising from use of the web sites. In cases where you feel threatened or believe someone else is in danger, you should contact your local law enforcement agency immediately.

The KW Military Support Foundation cannot and does not screen all content provided by you or other Users to the web Sites or any Interactive Area, and is not responsible for the content of these communications and materials. Notwithstanding the foregoing, the KW Military Support Foundation reserves the right to review the Web Sites and material from the web Sites brought to the KW Military Support Foundation’s attention and to remove content, which the KW Military Support Foundation , in its sole discretion, determines to be:

(a) abusive, libelous, defamatory or obscene,

(b) fraudulent, deceptive or misleading,


(c) in violation of a copyright or trademark, other intellectual property right of another,

(d) contradicts or undermines the KW Military Support Foundation ’s mission statement, or

(e) offensive or otherwise unacceptable to the KW Military Support Foundation.

The KW Military Support Foundation reserves the right to record the dialogue in public discussions. The KW Military Support Foundation does not screen communications in advance and is not responsible for screening or monitoring material posted by Users or any other person or entity. If notified by a User of communication(s) which are alleged not to conform to the terms of this Agreement, the KW Military Support Foundation may investigate the allegation and determine in its sole discretion to remove or request the removal of the communication(s). The KW Military Support Foundation reserves the right to remove communications which are abusive, illegal, disruptive, profane or that otherwise fail to conform to this Agreement. In addition to the removal rights described above, the KW Military Support Foundation reserves the right to terminate a User’s access to any or all Interactive Areas upon Subscriber’s breach of these Terms and Conditions. The KW Military Support Foundation reserves the right (but is not obligated) to edit or delete any communication(s) posted on the web sites, regardless of whether such communication(s) violate these standards for content..

If a user’s access is frozen there will be a message on the site that this has occurred. This message will tell the user who to contact and how to do so, to re-activate the access.

Furthermore, the KW Military Support Foundation reserves the right (but is not obligated) to monitor, edit or disclose any type of communication(s) on the Interactive Areas for adherence to this Agreement, if required in the course of normal operation and maintenance of the web sites, or if required to do so by law or in the good-faith belief that such action is necessary to:

(i) comply with the law or comply with legal process served;

(ii) protect and defend the rights of the KW Military Support Foundation or others; or


(iii) act in an emergency to protect the personal safety of our donors or the public.

THE KW Military Support Foundation HAS NO LIABILITY OR RESPONSIBILITY TO DONORS OR ANY OTHER PERSON OR ENTITY FOR PERFORMANCE OR NONPERFORMANCE OF THE AFOREMENTIONED SCREENING ACTIVITIES.

To prevent unauthorized access, maintain data accuracy, and ensure the correct use of information, we strive to maintain physical, electronic, and administrative safeguards. Your data is stored in password-controlled servers of our third party host partner that hosts our websites and assists us in maintaining our website. Our third party partner uses the most technologically advanced security measures to protect your information and is bound by a confidentiality and a non-sharing of your information  agreement. Several designated KW Military Support Foundation personnel have access to your information. These staff members are educated about the importance of safeguarding your information and are bound by a confidentiality agreement as well.​
